These Terms of Service ("Terms") govern your access to and use of thefinjansociety.com, our online store, and any related services, features, content, products, promotions, and functionality operated by TheFinjanSociety (collectively, the "Services").

Throughout these Terms, "TheFinjanSociety", "we", "us", and "our" refer to the operator of TheFinjanSociety.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.

By accessing our website, creating an account, placing an order, or otherwise using our Services, you agree to these Terms and our applicable policies, including our Privacy Policy and Return, Exchange & Refund Policy.

If you do not agree with these Terms, please do not use the Services.

Nothing in these Terms is intended to limit any mandatory rights granted to consumers under the laws and regulations of the State of Kuwait.

1. ELIGIBILITY AND ACCOUNTS

You may browse our website without creating an account where guest checkout is available.

If you create an account, you are responsible for:

For coffee products, characteristics such as:

• Flavor

• Aroma

• Acidity

• Sweetness

• Body

• Roast appearance

• Bean appearance

• Tasting notes

may naturally vary between harvests, batches, roasting dates, storage conditions, and brewing methods.

Tasting notes are intended to describe the sensory characteristics of a coffee and do not necessarily mean that the stated ingredients or flavors have been added to the coffee unless expressly stated in the product description.

Product descriptions, origins, processes, varietals, recommendations, brewing information, and tasting notes are provided for informational purposes based on information available to us and/or supplied by the relevant producer or roaster.

We reserve the right to update product descriptions or discontinue products, provided this does not affect any mandatory rights relating to orders already accepted.

3. PRODUCT AVAILABILITY

All products are subject to availability.

Adding a product to your cart does not reserve that product.

A product may become unavailable before checkout or before an order is accepted due to inventory differences, system errors, damaged inventory, supplier availability, or other operational reasons.

If you have paid for a product that we are unable to supply, we will contact you and provide an appropriate refund or alternative in accordance with applicable law.

We may reasonably limit quantities where necessary, including in cases of limited releases, suspected unauthorized resale, system errors, abuse of promotions, or unusually large orders.

4. ORDERS AND ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase the products included in your order.

Receipt of an order confirmation or payment authorization does not necessarily mean that your order has been finally accepted.

We may review an order before accepting it.

We may reject or cancel an order for legitimate reasons, including:

We will attempt to assist you where reasonably possible, but orders that have already been prepared, packed, dispatched, or transferred for delivery may not always be capable of modification or cancellation, subject always to your mandatory rights under Kuwait law.

5. PRICES

Unless otherwise stated, prices displayed on our store are in Kuwaiti Dinars (KWD).

The final amount payable will be displayed before you complete payment and may include:

• Product price.

• Delivery charges.

• Other charges that have been clearly disclosed and are lawfully applicable.

We reserve the right to change prices at any time before an order is placed.

Price changes will not affect an order that we have already accepted, except where there is an obvious pricing or technical error and applicable law permits correction.

We currently provide delivery within the State of Kuwait, unless otherwise expressly indicated at checkout.

Delivery costs, where applicable, will be disclosed before you complete your order.

Any delivery time displayed on our website or communicated to you is an estimate unless expressly stated otherwise.

We will make reasonable efforts to deliver your order within the estimated period.

Delivery may be affected by circumstances outside our reasonable control, including:

• Traffic conditions.

• Severe weather.

• Public emergencies.

• Government restrictions.

• Courier interruptions.

• Incorrect customer information.

• Events of force majeure.

Where a material delivery delay occurs, we will handle the matter in accordance with applicable Kuwait law.

• Delivery address.

• Area.

• Block.

• Street.

• Building or house number.

• Apartment or floor information, where applicable.

• Any other information reasonably necessary for delivery.

If delivery cannot be completed because the information supplied by you is materially incorrect or incomplete, we may contact you to arrange another delivery attempt.

Nothing in these Terms transfers the risk of loss or damage to you earlier than permitted under applicable Kuwait law.

9. RECEIVING AND INSPECTING YOUR ORDER

Please inspect your order as soon as reasonably possible after receiving it.

If you receive:

• A damaged product.

• A defective product.

• The wrong product.

• An incomplete order.

• An expired product.

• A spoiled or unsafe product.

• A product materially different from what was ordered.

We may reasonably request photographs, videos, the order number, packaging, or other information necessary to investigate the issue.

Do not consume a coffee or food product if its packaging appears materially damaged, opened, contaminated, or otherwise unsafe.

Confirmed issues will be handled in accordance with our Return, Exchange & Refund Policy and applicable Kuwait consumer-protection law.

10. RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges, and refunds are governed by our Return, Exchange & Refund Policy, which forms part of these Terms.

Consumers may have mandatory rights to return or exchange eligible products under Kuwait law.

Our policies are not intended to reduce or exclude those mandatory rights.

Certain products may be excluded from change-of-mind returns where permitted by law due to their nature, including certain opened, used, consumed, customized, or rapidly perishable products.

This does not remove your legal rights where a product is defective, damaged, expired, spoiled, incorrectly supplied, or otherwise not in conformity with your order or applicable legal requirements.

11. COFFEE AND FOOD PRODUCT RESPONSIBILITY

Coffee beans and other consumable products should be stored according to any instructions shown on their packaging.

After delivery, you are responsible for reasonable handling and storage of products.

You should not consume a product where:

• The packaging has been materially compromised.

• There are indications of contamination.

• The product is expired.

• There is another reasonable food-safety concern.

Please contact us immediately if you believe a product was delivered in an unsafe or defective condition.

Personal preference relating to taste, aroma, roast level, acidity, sweetness, processing method, body, or brewing result does not by itself establish that a product is defective.

12. WEBSITE CONTENT

We make reasonable efforts to keep information on our website accurate and current.

However, occasional errors may occur involving:

• Product descriptions.

• Prices.

• Availability.

• Promotions.

• Images.

• Delivery information.

• Technical information.

• Typographical errors.

Where legally permitted, we may correct errors and update information.

Any correction affecting an order you have already placed will be handled in accordance with applicable Kuwait law and your mandatory consumer rights.

is owned by or lawfully licensed to TheFinjanSociety and is protected by applicable intellectual-property laws.

You may use our website for lawful personal use.

You may not, without permission:

• Reproduce or imitate our branding.

• Use our logo or trademarks in a misleading manner.

We do not attempt through these Terms to exclude responsibility for defective or non-conforming goods where applicable consumer law gives you a remedy.

To the maximum extent permitted by applicable law, TheFinjanSociety will not be responsible for indirect or consequential losses arising solely from circumstances beyond our reasonable control or from misuse of the Services by a customer.

We are also not responsible for temporary website interruptions or technical failures outside our reasonable control, provided that this does not limit any obligation relating to an accepted customer order that applicable law requires us to fulfil.

Your statutory consumer rights remain unaffected.

21. FORCE MAJEURE

We will not be responsible for a failure or delay caused by circumstances genuinely outside our reasonable control, to the extent permitted by applicable law.

Such circumstances may include natural disasters, government actions, major telecommunications failures, public emergencies, strikes affecting third parties, transportation disruptions, or similar events.

If such circumstances materially affect an accepted order, we will communicate with you and provide any remedy required under applicable law.

22. SEVERABILITY

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be applied or limited to the maximum extent permitted by law.

The remaining provisions will continue to apply.

23. NO WAIVER

If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive our right to enforce it.

24. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect:

Nothing in these Terms prevents a consumer from exercising any right to submit a complaint to the Kuwait Ministry of Commerce and Industry or another competent authority in accordance with applicable procedures.

26. LANGUAGE

These Terms may be made available in both Arabic and English.

Both versions are intended to communicate the same terms.

If a difference in interpretation arises between the two versions, the Arabic version will prevail to the extent required or permitted by applicable Kuwait law.

3. توافر المنتجات

جميع المنتجات تخضع للتوافر.

إضافة منتج إلى سلة التسوق لا تعني حجز المنتج بشكل نهائي.

قد ينفد المنتج قبل إتمام الطلب بسبب المخزون أو اختلاف الكميات أو تلف منتج أو خطأ تقني أو أسباب تشغيلية أخرى.

إذا تم دفع قيمة منتج وتعذر علينا توفيره، فسنتواصل معكم وسيتم التعامل مع المبلغ المدفوع وفقاً للقانون وسياسة الاسترداد الخاصة بنا.

4. الطلبات وقبولها

عند تقديم الطلب، يقدم العميل طلباً لشراء المنتجات المحددة.

قد يخضع الطلب للمراجعة قبل قبوله بشكل نهائي.

يجوز لنا رفض أو إلغاء الطلب لأسباب مشروعة، منها:

• عدم توافر المنتج.

• وجود خطأ واضح في السعر أو معلومات المنتج.

• فشل عملية الدفع.

• الاشتباه في الاحتيال أو استخدام وسيلة دفع دون تصريح.

• وجود خطأ تقني أو خطأ في المخزون.

• بيانات توصيل غير صحيحة أو ناقصة.

• مخالفة هذه الشروط.

• متطلبات قانونية أو تنظيمية.

إذا تم إلغاء الطلب بعد تحصيل المبلغ، سيتم رد أي مبلغ مستحق وفقاً للقانون وسياسة الاسترداد.

5. الأسعار

تظهر أسعار منتجاتنا بـ الدينار الكويتي (KWD) ما لم يتم توضيح خلاف ذلك.

سيظهر السعر النهائي المستحق قبل تأكيد عملية الدفع، وقد يشمل:

• سعر المنتجات.

• رسوم التوصيل.

• أي رسوم أخرى تم الإفصاح عنها بوضوح ويجوز تحصيلها قانوناً.

يجوز تعديل الأسعار قبل تقديم الطلب.

ولا تؤثر التغييرات اللاحقة في الأسعار على الطلبات المقبولة سابقاً، مع مراعاة الحالات التي يكون فيها هناك خطأ واضح في السعر أو النظام وما يسمح به القانون.

6. الدفع

نقبل وسائل الدفع المتاحة والمبينة للعميل عند إتمام الطلب.

وقد تتم معالجة عمليات الدفع من خلال مزودي خدمات دفع من أطراف خارجية.

يقر العميل بأنه مخول باستخدام وسيلة الدفع التي يستخدمها في الطلب.

ولا يتم فرض أي رسوم إضافية من جانبنا على وسائل الدفع الإلكتروني إلا إذا كان ذلك مسموحاً به قانوناً وتم الإفصاح عنها بشكل واضح قبل إتمام عملية الشراء.

7. العروض والخصومات وأكواد الخصم

قد نقدم من وقت لآخر:

• أكواد خصم.

• عروضاً ترويجية.

• أسعاراً مخفضة.

• عروض باقات.

• هدايا مع الطلبات.

• نقاط أو مكافآت ولاء.

• عروضاً محدودة المدة.

وقد تخضع هذه العروض لشروط إضافية مثل مدة العرض أو الحد الأدنى للطلب أو المنتجات المشمولة أو عدد مرات الاستخدام.

ولا يؤدي شراء المنتج أثناء التخفيض أو باستخدام كود خصم إلى إلغاء الحقوق الإلزامية للمستهلك في الإرجاع أو الاستبدال أو الضمان وفقاً للقوانين المعمول بها في دولة الكويت.

8. التوصيل

يتم التوصيل حالياً داخل دولة الكويت ما لم يتم توضيح خلاف ذلك عند إتمام الطلب.

يتم توضيح رسوم التوصيل، إن وجدت، قبل إتمام عملية الشراء.

أي موعد أو مدة توصيل يتم عرضها على الموقع تعتبر تقديرية ما لم يتم النص صراحةً على خلاف ذلك.

نبذل جهداً معقولاً لتوصيل الطلب خلال الفترة المحددة.

وقد يتأثر التوصيل بظروف خارجة عن إرادتنا، بما في ذلك:

• الازدحام المروري.

• الظروف الجوية الشديدة.

• حالات الطوارئ.

• القيود الحكومية.

• مشاكل شركات التوصيل.

• البيانات غير الصحيحة المقدمة من العميل.

• حالات القوة القاهرة.

وفي حال حدوث تأخير جوهري، سيتم التعامل معه وفقاً للقوانين المعمول بها في دولة الكويت.

يتحمل العميل مسؤولية توفير بيانات توصيل صحيحة، بما في ذلك الاسم ورقم الهاتف والمنطقة والقطعة والشارع ورقم المنزل أو المبنى وأي تفاصيل لازمة لإتمام التوصيل.

ولا تنقل هذه الشروط مخاطر فقدان أو تلف الطلب إلى العميل في وقت أبكر مما يسمح به القانون الكويتي.

9. فحص الطلب عند الاستلام

يرجى فحص الطلب فور استلامه أو في أقرب وقت ممكن.

يرجى التواصل معنا في حال استلام:

• منتج تالف.

• منتج معيب.

• منتج مختلف عن المطلوب.

• طلب ناقص.

• منتج منتهي الصلاحية.

• منتج فاسد أو غير آمن.

• منتج يختلف بصورة جوهرية عن المنتج المطلوب.

وقد نطلب رقم الطلب وصوراً أو مقاطع فيديو أو صوراً للتغليف للمساعدة في تقييم المشكلة.

يرجى عدم استهلاك أي منتج غذائي إذا كان التغليف مفتوحاً أو متضرراً بصورة جوهرية أو توجد علامات تدل على احتمال عدم سلامة المنتج.

10. الإرجاع والاستبدال واسترداد المبالغ

تخضع عمليات الإرجاع والاستبدال واسترداد المبالغ إلى سياسة الإرجاع والاستبدال واسترداد المبالغ الخاصة بنا، والتي تعتبر جزءاً من هذه الشروط.

يتمتع المستهلك بحقوق إلزامية بموجب قوانين حماية المستهلك في دولة الكويت.

ولا تهدف سياستنا إلى الحد من تلك الحقوق.

قد لا تكون بعض المنتجات مؤهلة للإرجاع بسبب تغيير الرأي عندما يسمح القانون بذلك، بما في ذلك بعض المنتجات التي تم فتحها أو استخدامها أو استهلاكها أو تصنيعها حسب الطلب أو المنتجات سريعة التلف.

ولا يسري ذلك بما ينتقص من حقوق العميل إذا كان المنتج معيباً أو تالفاً أو منتهي الصلاحية أو فاسداً أو تم إرسال منتج غير صحيح أو كان المنتج مخالفاً لما تم الاتفاق عليه.

11. القهوة والمنتجات الغذائية

يجب تخزين القهوة والمنتجات الغذائية بطريقة مناسبة ووفقاً لأي تعليمات مذكورة على العبوة.

بعد استلام المنتج، يكون العميل مسؤولاً عن التعامل معه وتخزينه بصورة معقولة.

وينبغي عدم استهلاك المنتج إذا:

• كان التغليف متضرراً بصورة جوهرية.

• كانت هناك علامات تلوث.

• انتهت صلاحية المنتج.

• وجدت أسباب معقولة للشك في سلامته.

ولا يعتبر اختلاف المذاق الشخصي من حيث الحموضة أو الحلاوة أو التحميص أو النكهات أو القوام أو طريقة المعالجة عيباً في المنتج بحد ذاته.

12. معلومات الموقع والأخطاء

نبذل جهداً معقولاً للحفاظ على دقة المعلومات الموجودة على الموقع.

ومع ذلك، قد تحدث أخطاء تتعلق بـ:

• وصف المنتجات.

• الأسعار.

• المخزون.

• العروض.

• الصور.

• معلومات التوصيل.

• الأخطاء التقنية أو الكتابية.

يجوز لنا تصحيح تلك الأخطاء وتحديث المعلومات متى كان ذلك مسموحاً قانوناً.

وأي تصحيح يؤثر على طلب تم تقديمه بالفعل سيتم التعامل معه وفقاً للقانون وحقوق المستهلك.

13. حقوق الملكية الفكرية

ما لم يتم ذكر خلاف ذلك، فإن المحتوى الأصلي الخاص بـ TheFinjanSociety، بما في ذلك الاسم والعلامة التجارية والشعارات والتصاميم والصور والفيديوهات والنصوص والمواد التسويقية، مملوك لنا أو مرخص لنا باستخدامه ومحمي وفقاً لقوانين الملكية الفكرية المعمول بها.

لا يجوز دون موافقتنا:

• استخدام المحتوى الأصلي الخاص بنا لأغراض تجارية.

• نسخ أو تقليد علامتنا التجارية.

• استخدام شعارنا بطريقة مضللة.

• إعادة نشر أجزاء جوهرية من الموقع.

• الإيحاء بوجود شراكة أو تفويض أو تأييد غير موجود من جانبنا.

وتظل العلامات التجارية والمواد والعبوات الخاصة بالمحامص والمصنعين والموردين الآخرين ملكاً لأصحابها.

14. الاستخدام المقبول

لا يجوز استخدام الموقع أو خدماتنا:

• لأغراض غير قانونية.

• للاحتيال.

• لتقديم معلومات دفع أو هوية مزيفة.

• للإضرار بأمن الموقع.

• لإرسال فيروسات أو برامج ضارة.

• للدخول غير المصرح به إلى الأنظمة أو الحسابات.

• لانتهاك حقوق الملكية الفكرية.

• لمضايقة أو تهديد أي شخص.

• لتعطيل تشغيل أو أمان الخدمات بصورة جوهرية.

15. خدمات وروابط الأطراف الثالثة

قد نستخدم أو نوفر روابط لخدمات أطراف ثالثة، بما في ذلك:

• مزودي خدمات الدفع.

• شركات التوصيل.

• خدمات التحليلات.

• وسائل التواصل الاجتماعي.

• أدوات خدمة العملاء.

• خدمات التسويق.

• مقدمي الخدمات التقنية.

وقد تكون لتلك الجهات شروط وسياسات خصوصية مستقلة.

ولا يعفي استخدام طرف ثالث TheFinjanSociety من أي مسؤولية يتطلب القانون أن نتحملها تجاه العميل فيما يتعلق بتنفيذ طلبه.

16. SHOPIFY

يعمل متجرنا الإلكتروني من خلال منصة Shopify.

توفر Shopify البنية التقنية اللازمة لتشغيل المتجر، ولكنها ليست البائع للمنتجات التي يشتريها العميل مباشرة من TheFinjanSociety.

عقد شراء المنتجات المعروضة من خلال متجرنا يكون بين العميل وTheFinjanSociety، ما لم يتم توضيح خلاف ذلك.

17. الخصوصية

نحترم خصوصية عملائنا.

تخضع عملية جمع واستخدام المعلومات الشخصية إلى سياسة الخصوصية الخاصة بنا والقوانين واللوائح المعمول بها.

وقد تتم معالجة بعض البيانات بواسطة Shopify ومزودي الخدمات الآخرين لتقديم خدمات مثل الدفع والتوصيل والاستضافة ومنع الاحتيال وخدمة العملاء والتحليلات.

18. التقييمات والمحتوى المقدم من العملاء

عند تقديم تقييم أو صورة أو اقتراح أو أي محتوى لنا، يقر العميل بأن لديه الحق في تقديم ذلك المحتوى.

ولا يجوز تقديم محتوى يكون بشكل متعمد:

• كاذباً أو مضللاً.

• مخالفاً للقانون.

• مسيئاً أو تهديدياً.

• منتهكاً لحقوق الملكية الفكرية أو الخصوصية.

• ضاراً من الناحية التقنية.

وعند تقديم محتوى لنا بغرض نشره، يمنحنا العميل حقاً غير حصري لاستخدامه وعرضه في إطار تشغيل وتسويق TheFinjanSociety، وفقاً للقانون.

19. تعليق أو إنهاء الاستخدام

يجوز لنا تقييد أو إنهاء استخدام الخدمات عندما يكون ذلك ضرورياً بصورة معقولة بسبب الاحتيال أو مخاطر أمنية أو نشاط غير قانوني أو إساءة استخدام خطيرة أو مخالفة متكررة لهذه الشروط.

ولا يؤثر إنهاء الوصول إلى الموقع على حقوق العميل المتعلقة بطلب تم قبوله أو على حقوق المستهلك الإلزامية.

20. المسؤولية والضمانات

لا تهدف أي فقرة من هذه الشروط إلى استبعاد أو تقييد مسؤولية أو حق لا يسمح القانون الكويتي باستبعاده أو تقييده.

ولا نستبعد بموجب هذه الشروط مسؤوليتنا عن المنتجات المعيبة أو غير المطابقة عندما يمنح القانون المستهلك حقاً في التعويض أو الإرجاع أو الاستبدال.

وفي الحدود التي يسمح بها القانون، لا نتحمل المسؤولية عن الأضرار غير المباشرة الناتجة حصراً عن ظروف خارجة عن سيطرتنا المعقولة أو عن سوء استخدام العميل للخدمات.

وتظل جميع الحقوق القانونية الإلزامية للمستهلك محفوظة.

21. القوة القاهرة

لا نتحمل المسؤولية عن التأخير أو عدم التنفيذ الناتج عن أحداث خارجة فعلياً عن سيطرتنا المعقولة، وذلك في الحدود التي يسمح بها القانون.

وفي حال تأثير تلك الظروف بصورة جوهرية على طلب مقبول، سنقوم بالتواصل مع العميل وتوفير أي حقوق أو حلول يفرضها القانون.

22. قابلية فصل الأحكام

إذا تقرر أن أحد بنود هذه الشروط غير قانوني أو غير صالح أو غير قابل للتنفيذ، يتم تطبيقه بالحد الأقصى الذي يسمح به القانون أو يتم استبعاد الجزء غير القابل للتنفيذ.

وتظل باقي الشروط سارية.

23. عدم التنازل عن الحقوق

عدم قيامنا بممارسة أي حق بصورة فورية لا يعني تنازلنا عنه مستقبلاً.

24. تعديل الشروط

يجوز لنا تحديث هذه الشروط من وقت لآخر نتيجة:

• تغيير الخدمات.

• متطلبات تشغيلية.

• تغير القوانين واللوائح.

• متطلبات الجهات التنظيمية.

• متطلبات أمنية أو تقنية.

سيتم نشر أحدث نسخة من الشروط على الموقع.

ولا تؤدي التغييرات اللاحقة إلى إلغاء حقوق اكتسبها العميل مسبقاً بشأن طلب تم قبوله، إلا إذا كان القانون ينص على خلاف ذلك.

25. القانون المختص وتسوية المنازعات

تخضع هذه الشروط وعمليات الشراء التي تتم من خلال TheFinjanSociety إلى القوانين واللوائح المعمول بها في دولة الكويت.

وتخضع أي منازعة للجهات والمحاكم المختصة في دولة الكويت، مع مراعاة أي إجراءات إلزامية أو حقوق خاصة بالمستهلك ينص عليها القانون.

ولا تمنع هذه الشروط المستهلك من ممارسة حقه في تقديم شكوى إلى وزارة التجارة والصناعة في دولة الكويت أو أي جهة مختصة أخرى وفقاً للإجراءات المعمول بها.

26. اللغة

يمكن توفير هذه الشروط باللغتين العربية والإنجليزية.

وتهدف النسختان إلى التعبير عن الشروط ذاتها.

وفي حال وجود اختلاف في التفسير بين النسختين، تكون النسخة العربية هي المرجع بالقدر الذي يتطلبه أو يسمح به القانون المعمول به في دولة الكويت.
